Ultra Vigilant? Or Ultra Creepy?: Whether it's due to concerns about terrorism, theft, or workplace violence, more and more jobs are requiring a background check these days. While it may not be so surprising that certain jobs, such as elementary school teacher, bus driver, or bank teller, require background checks, especially when checks may even be required by law, it may surprise you that some companies now require checks for all employees, from CEO on down. And the extent of the checks may also surprise you, as a new company, Verified Person, now offers employers the ability to conduct new checks every other week. One company using the service claims they're just being "ultra vigilant," but some might find the pervasiveness of the checks just as creepy as the stalkers and criminals their employers are hoping to ferret out.

Hulteen v. AT&T Corp.  (Ninth Circuit; No. 04-16087)
Decision Date: March 8, 2006
Summary judgment for plaintiffs in a Title VII case alleging discrimination by en employer against women who took pregnancy-related leaves before 1979 is reversed where: 1) the Pregnancy Discrimination Act cannot be applied retroactively either to invalidate an original accounting scheme for pregnancy leaves or to create a current violation of Title VII by defendant; 2) plaintiffs' suit was not based on a facially discriminatory retirement system and was thus time-barred; and 3) certain case law precedent could not be viewed as binding.
Decision Date: March 6, 2006
Summary judgment for defendant-employer, corrections facility, on plaintiff's due process and employment-discrimination claims is reversed in part where plaintiff created a genuine issue of material fact as to: 1) why she was paid less than another employee, and as to why her employment was terminated; and 2) whether defendant fired her because she complained of disparate pay.
