Senators are letting themselves off the hook with sexual harassment bill, women’s rights groups say

Sexual harassment in Congress is a scandal—and it would probably be a lot more of one if Congress hadn’t written its own rules for dealing with allegations in secret. But since the #MeToo movement has shined a light on sexual harassment, the House of Representatives has managed to pass a decent bill. The Senate 
 hasn’t, and the bill it has coming up for a vote is not the answer. The American Civil Liberties Union, Equal Pay Today, the Leadership Conference on Civil and Human Rights, National Women’s Law Center, and Public Citizen are calling on the Senate to strengthen its bill.

Their letter points to serious weaknesses in the Senate bill, including that it doesn’t call for an independent investigator, instead putting approval of settlements in the hands of the ethics committees of both the House and the Senate to sign off on if the settlement is because of a member of Congress’s own actions:

“This provision appears to provide an opportunity for a Member who has settled a claim to avoid personal accountability and to be absolved from reimbursing the taxpayers,” the groups wrote in the letter.

Additionally, the Senate bill fails to hold members liable for discrimination settlements:

“A Member who has committed wrongdoing should be liable for all damages negotiated in a settlement or awarded by a court; they should not be shielded from the consequences of their actions,” they wrote.

Seriously. Time for Congress to be held accountable—and the way for that to happen is for Congress to write its own rules to demand accountability.

Don’t Pass Huge Tax Cuts for the Wealthy on the Backs of Working People

Republican leaders in the U.S. Senate have proposed a job-killing tax plan that favors the super-rich and wealthy corporations over working people. We cannot afford to let this bill become law.

Here’s why this plan is a bad idea:

  • Millions of working people would pay more. People making under $40,000 would be worse off, on average, in 2021; and people making under $75,000 would be worse off, on average, in 2027.
  • The super-rich and Wall Street would make out like bandits. The richest 0.1% would get an average tax cut of more than $208,000, and 62% of the benefits of the Senate bill would go to the richest 1%. Big banks, hedge funds and other Wall Street firms would be the biggest beneficiaries of key provisions of the bill.
  • Job-killing tax breaks for outsourcing. The Republican tax plan would lower the U.S. tax rate on offshore profits to zero, giving corporations more incentive to move American jobs offshore. 
  • Working people would lose health care. Thirteen million people would lose health insurance, and health care premiums would rise 10% in the non-group market. Meanwhile, Republicans want to cut Medicaid and Medicare by $1.5 trillion—the same price tag as their tax bill.
  • Job-killing cuts to infrastructure and education. Eliminating the deduction for state and local taxes would drastically reduce state and local investment in infrastructure and lead to $350 billion in education cuts, jeopardizing the jobs of 350,000 educators.

Republican tax and budget plans would make working people pay the price for wasteful tax giveaways by sending our jobs overseas; killing jobs in infrastructure and education; raising our taxes; increasing the number of uninsured; and cutting the essential public services we depend on.

Republicans want to give corporations yet another tax cut and call it paid family leave

Americans want paid family leave—something people in most nations around the world already get. So it sounds like something to cheer that there’s a paid family leave provision in the Senate Republican tax plan, right? Yeah, no. This is very much a Republican family leave proposal, which is to say it’s a giveaway to big corporations that won’t get much for working Americans. 

The bill would give companies a tax credit for a small proportion of the worker’s pay, companies only get the credit at the end of the year—so if they can’t afford to offer leave up front, they can’t take advantage of it—and it expires in 2019.

“It’s a flimflam,” said Ellen Bravo, co-director at Family Values@Work, a national coalition of paid leave advocates. “It’s pretending to say we’re giving you something new that people urgently need when, in fact, it’s a giveaway to the bigger corporations that can already afford to do it.” […]

Several conservative economists agree. This kind of tax credit would most likely be embraced by companies that already offer paid family leave, wrote Aparna Mathur, a resident scholar in economic policy at the American Enterprise Institute.

“This is only a small step forward in this debate, not a giant leap,” Mathur said. “Much more can and should be done.”

Not to mention, including something they can call paid family leave is a great Republican trick for pretending their giant tax cuts for rich people package is good for working families. And—like this flimflam proposal—it’s just not.

Trump is about to make America much crueler to unionized workers

Since Election Day, unions have lived on borrowed time. The National Labor Relations Board (NLRB), which has exclusive authority over many key questions of labor law, is still controlled by Democrats?—?thus shielding workers and their unions from attacks that became far likelier the moment Donald Trump was declared the winner of the 2016 election.

But this period of interregnum is about to end. Senate Majority Leader Mitch McConnell (R-KY) began the process of confirming the first of Trump’s two nominees to the NLRB on Monday. When both nominees sit on the Board, a swift rollback of union rights is likely.

As soon as this week, the Senate is likely to vote on Marvin Kaplan, the first of these two nominees. A former GOP Hill staffer, Kaplan drafted legislation—strongly supported by business lobby groups—which would have made it easier for employers to fight unionization campaigns.

Trump’s other nominee, William Emanuel, is a veteran management-side lawyer who touts his “particular expertise with laws concerning union access to the private property of employers.” He’s also filed briefs in three cases claiming that employers can force workers to waive their right to bring class actions and similar lawsuits.

The NLRB is an unusual agency that functions very much like a judicial body. It is the only agency that can enforce certain portions of federal labor law, which protects the right to unionize, to engage in collective action within the workplace, and to have one’s employer actually bargain with a union in good faith.

While the NLRB employs lawyers who investigate and prosecute certain violations of labor law, the board members themselves function much like judges?—?sitting on individual cases and handing down precedential opinions interpreting the rights of workers, unions, and employers.

In recent years, however, the Board has grown increasingly partisan. By design, it has five board members, and three of those seats are typically controlled by the party that also controls the White House. For this reason, the Board’s understanding of labor law often lurches to the left and then to the right as control of the presidency changes hands.

During the second Bush administration, for example, the NLRB determined that workers with fairly minimal authority over their co-workers count as “supervisors” under federal labor law?—?and thus do not enjoy a legal right to unionize. The Board’s current Democratic majority, by contrast, appears much less eager to strip employees’ collective bargaining rights by declaring them “supervisors.”

Yet, while partisanship has shaped the NLRB’s decisions for quite a while, if Kaplan and Emanuel are confirmed, the Board will have a Republican majority for the first time in the post-Tea Party, take-no-prisoners era of GOP politics that began shortly after the Obamas moved into the White House.

The new majority on the board is likely to confront, and possibly reverse, a number of Obama-era decisions on important matters such as whether graduate students with significant work responsibilities should be allowed to unionize.

But the GOP’s recent approach to unions suggests that the party will not be satisfied with simply rolling back union rights to where they stood in the Bush era. Last year, the Supreme Court came within a hair of defunding many public sector unions based on an aggressive reading of the First Amendment?—?the suit failed only due to Justice Antonin Scalia’s death, and a similar suit is likely to prevail soon now that Neil Gorsuch occupies Scalia’s seat.

Republican governors like Scott Walker crusaded against unions in their states. Senate Republicans even attempted to shut down the NLRB entirely during the Obama presidency?—?an action that would have rendered much of federal labor law unenforceable?—?by refusing to fill vacancies on the Board.

It is likely, in other words, that the NLRB’s incoming majority will push much harder against the right to organize than even President Bush’s appointees to the Board. They are creatures of a very different era.

Veto the Cold-Hearted Health Bill

Donald Trump is right. The House health insurance bill is “mean, mean, mean,” as he put it last week. He correctly called the measure that would strip health insurance from 23 million Americans “a son of a bitch.”

The proposal is not at all what Donald Trump promised Americans. He said that under his administration, no one would lose coverage. He said everybody would be insured. And the insurance he provided would be a “lot less expensive.”

Senate Democrats spent every day this week pointing this out and demanding that Senate Republicans end their furtive, star-chamber scheming and expose their health insurance proposal to public scrutiny. That unveiling is supposed to happen today.

Republicans have kept their plan under wraps because, like the House measure, it is a son of a bitch. Among other serious problems, it would restore caps on coverage so that if a young couple’s baby is born with serious heart problems, as comedian Jimmy Kimmel’s was, they’d be bankrupted and future treatment for the infant jeopardized.

Donald Trump has warned Senate Republicans, though. Even if the GOP thinks it was fun to rebuff Democrats’ pleas for a public process, they really should pay attention to the President. He’s got veto power.

Republicans have spent the past six years condemning the Affordable Care Act (ACA), which passed in 2010 after Senate Democrats accepted 160 Republican amendments, held 110 bipartisan public hearings and conducted 25 consecutive days of public floor debate. Despite all of that, Republicans contend the ACA is the worst thing since Hitler.

That is what they assert about a law that increased the number of insured Americans by 20 million, prohibited discrimination against people with pre-existing conditions and eliminated the annual and lifetime caps that insurers used to cut off coverage for sick infants and people with cancer.

The entire cavalry of Republican candidates for the GOP nomination for President promised to repeal the ACA, but Donald Trump went further. He pledged to replace it with a big league better bill.

In May 2015, he announced on Twitter: “I’m not going to cut Social Security like every other Republican and I’m not going to cut Medicare or Medicaid.”

In September 2015, he said of his health insurance plans on CBS News’ 60 Minutes, “I am going to take care of everybody. I don’t care if it costs me votes or not. Everybody’s going to be taken care of much better than they’re taken care of now.”

In another 60 Minutes interview, this one with Lesley Stahl last November, he said, “And it’ll be great health care for much less money. So it’ll be better health care, much better, for less money. Not a bad combination.”

In January, he told the Washington Post, “We’re going to have insurance for everybody.” He explained, “There was a philosophy in some circles that if you can’t pay for it, you don’t get it. That’s not going to happen with us.”

But then, the House Republicans betrayed him. The nonpartisan Congressional Budget Office said the measure they passed, called the American Health Care Act (AHCA), would cut more than $800 billion from Medicaid. It said people with pre-existing conditions and some older Americans would face “extremely high premiums.”

Extremely high is an understatement. Here is an example from the CBO report: A 64-year-old with a $26,500 income pays $1,700 for coverage under the Affordable Care Act (ACA), but would be forced to cough up more than half of his or her income – $16,000 – for insurance under the House Republican plan. Overall, premiums would increase 20 percent in the first year. And insurers could charge older people five times the rate they bill younger Americans.

House Republicans said states could permit insurers to squirm out of federal minimum coverage requirements, and in states where that occurred, the CBO said some consumers would be hit with thousands of dollars in increased costs for maternity care, mental health treatment and substance abuse services.

In the first year, the House GOP plan would rob insurance from 14 million Americans.

So much for covering everyone with “great health care at much less money.”

It’s true that President Trump held a party for House Republicans in the Rose Garden after they narrowly passed their bill. But it seems like he did not become aware until later just how horrific the measure is, how signing it into law would make him look like a rank politician, a swamp dweller who spouts promises he has no intention of keeping.

By last week when President Trump met with 15 Senate Republicans about their efforts to pass a health insurance bill, he no longer was reveling in the House measure. He called it “cold-hearted.” He asked the senators to be more “generous,” to put “additional money” into their version.

Senators told reporters that President Trump wanted them to pass a bill that is not viewed as an attack on low-income Americans and provides larger tax credits to enable people to buy insurance.

Now that sounds a little more like the Donald Trump who repeatedly promised his health insurance replacement bill would cover everyone at a lower cost. Still, those goals remain amorphous.

The House bill is stunningly unpopular, almost as detested as Congress itself. President Trump seems to grasp the enormity of that problem. But even his calling it a “son of a bitch” doesn’t seem to have been enough to persuade senators that he’s serious about getting legislation that achieves his promises to leave Medicaid intact, cover everyone and lower costs.

Republican senators deciding the fate of millions of Americans must hear from Donald Trump that passing a health insurance bill that doesn’t fulfill his campaign promises is, shall we say, a cancer on the Presidency.

A veto threat would get their attention.

The New Agenda For Taking On Wall Street

poole-60x60More than 20 progressive organizations representing millions of voters are putting their weight behind a five-point agenda for the next stage of Wall Street reform. What these groups will formally announce Tuesday, in an event featuring Massachusetts Sen. Elizabeth Warren, sets a high but practical standard for what a candidate would have to embrace to be considered a progressive on reining in the financial sector.

The Take On Wall Street campaign says it intends to ensure that the voices of working people and consumers are heard above the power and influence of Wall Street. The Washington Post reports that Take On Wall Street will combine the efforts of “some of the Democratic parties biggest traditional backers, from the American Federation of Teachers and the AFL-CIO to the Communications Workers of America.”

The campaign is pressing five changes that the coalition says would lead to a fair financial system that works for Main Street and working families, not just Wall Street billionaires. Most are embodied in legislation that is currently pending in Congress:

? Close the carried interest loophole. That’s the tax code provision that allows hedge fund and private equity managers to pay a lower tax rate on their earnings than what ordinary workers pay on what they earn. The Carried Interest Fairness Act (H.R. 2889) would end this inequity.

? End the CEO bonus loophole. That loophole allows corporations to write off a large share of CEO pay as a tax deduction – by calling it “performance-based” pay. The result is that taxpayers are subsidizing CEO pay to the tune of $5 billion a year. That amount of money would cover Head Start for more than 590,000 children, or pay the health care costs of more than 480,000 military veterans, or fund full scholarships for more than 600,000 college students. The Stop Subsidizing Multimillion Dollar Corporate Bonuses Act (H.R.2103) would end taxpayers subsidizing CEOs and allow those dollars to be used for such priorities as education and health care.

? End “too big to fail.” Both Democratic presidential candidates, Hillary Clinton and Bernie Sanders, say they agree with the principle that banks that are “too big to fail are too big to exist,” but Clinton is adamantly opposed to the one thing many economists and banking experts believe would help avert the need to bail out a “too big to fail” bank: a legal wall separating consumer banking from high-risk investment and trading activity. The Return to Prudent Banking Act of 2015 (H.R.381) and 21st Century Glass-Steagall Act (H.R. 3054) would bring back a version of the Glass-Steagall Act, which was repealed in the 1990s under President Bill Clinton.

? Enact a Wall Street speculation tax. It’s not right that consumers pay a sales tax on most things they buy, but traders don’t pay a sales tax on the stocks they buy. A tiny tax on the sale of Wall Street financial products – like the one envisioned in the Inclusive Prosperity Act of 2015 (H.R.1464) would raise billions of dollars for critical public needs, and could serve as a brake on high-speed computerized speculation that risks destabilizing markets. This tax would go farther than a narrowly targeted tax that Clinton has proposed.

? End predatory lending and offer alternatives for the “unbanked.” The coalition is throwing its support behind efforts by the Consumer Financial Protection Bureau to enact tough new regulations against payday and title lenders, which frequently entrap low-income borrowers in a quicksand of debt through sky-high, often three-digit interest rates and exorbitant fees. It also champions such “public option” alternatives as allowing the U.S. Postal Service to offer basic banking services.

All of these ideas have been proffered by progressive financial reformers even as the Dodd-Frank financial reform law squeaked through Congress in 2010. But this promises to be the broadest effort yet to combine these proposals into a singular reform push, and it comes as jockeying begins to shape the Democratic Party platform. As The Post notes, “Unlike previous anti-Wall Street campaigns such as Occupy Wall Street this group hopes to organize a campaign that will span state houses and as well as the halls of Congress, potentially forecasting a big fight on financial reform in 2017.”

It also comes as many in the Wall Street financial community turn to Clinton as the sane alternative to Republican presidential nominee Donald Trump in the general election campaign. These money interests will want Clinton to assure them that her get-tough rhetoric is nothing more than political red meat to assuage an angry populist electorate; their hope is that if the pivot to a centrist posture doesn’t happen in the general election, it will surely happen once she secures the presidency. But broad support for the Take On Wall Street agenda will limit Clinton’s ability to pivot, especially if this agenda helps elect new Senate and House members committed to not allowing Wall Street to keep rigging the economy against the rest of us.

A Big Win for Senate Cafeteria Workers

poole-60x60A sustained campaign on behalf of Senate cafeteria workers – including a 63-year-old employee who was homeless because he could not earn enough money to afford an apartment – has succeeded this week in getting these workers a desperately needed boost in pay and benefits.

Thanks to the organizing efforts of Good Jobs Nation and other allies, Senate officials signed a new contract with the workers that raises their minimum pay to $13.30 an hour and brings the average pay to workers close to the $15 an hour that the workers were demanding.

News of the agreement was published Monday by The Washington Post.

The Senate cafeteria workers were held up as a prime example of the kinds of poverty-wage jobs held by people under federal contracts. The company with the contract to manage the Senate cafeteria, Restaurant Associates, is part of a multinational corporation that boasted inits 2014 annual report that it had done well enough to offer to increase its dividend payments to shareholders by 10.5 percent as well as return 1.5 billion pounds – more than $2 billion – to shareholders via share buybacks and other means.

There was plenty of room to give a raise to stockholders, but not to the Senate cafeteria workers – at least not until the Senate cafeteria workers put their own jobs on the line to call attention to their plight. Their bold decision to hold one-day strikes, lead demonstrations and tell their stories led to several Democratic senators – including Minority Leader Harry Reid, Sherrod Brown, Elizabeth Warren and Bernie Sanders – and their staffs announcing a boycott of the cafeteria every Wednesday until the demands of the cafeteria workers were met.

The pressure on behalf of the workers appears to have made an impression on Sen. Roy Blunt (R-Mo.), the chairman of the Senate Rules and Administration Committee, who when signing the new contract said that he was “glad their concerns were heard and taken into consideration in the new contract.”

One concern, though, remains unaddressed: the workers’ demand for the ability to form a union. Restaurant Associates remains subject to complaints filed with the National Labor Relations Board that they have improperly interfered with the ability of the cafeteria workers to organize. Paco Fabian, a spokesman for Good Jobs Nation, was quoted in The Washington Post as saying that the cafeteria workers “won’t stop fighting until they get a voice on the job.” And neither should we.

Standing In Solidarity With Low-Wage Workers At the U.S. Senate

PooleU.S. senators and their staff only have to go to the Senate cafeteria to see what is wrong with the low-wage economy, with the workers who serve their meals earning near-poverty wages paid by the subsidiary of a multinational corporation that has blocked efforts by the workers to fight for better wages and working conditions.

Their struggle was made most vivid recently by the story of Charles Gladden, a Senate cafeteria worker who was homeless, earning only about $360 a week.

On Wednesday, some of those staffers made a point of showing that they understand what those workers are struggling with and are standing with them.

Their show of solidarity took the form of a “brown bag boycott,” in which they brought their own brown-bag lunches to the cafeteria. Joining the 40 or so Senate staffers who participated in the protest was Sen. Sherrod Brown (D-Ohio). He promised that the boycott would not be a one-time event.

“We will be here every Wednesday until you are treated fairly,” said Brown.

Senate cafeteria workers have been doing battle with the federal contractor for Senate food services, Restaurant Associates, for several years for a $15-an-hour wage and the right to collective bargaining. They have staged one-day strikes and protests to ratchet up the pressure.

Last week two of the cafeteria workers wrote an op-ed in The Hill newspaper to outline their struggle, including the efforts by Restaurant Associates to thwart their worker organizing efforts.

“Since we started organizing, we’ve been relentlessly harassed and intimidated by our bosses. Managers have threatened to fire us, questioned us about our organizing efforts, cut our hours, changed our schedules, increased our workloads, and ordered us not to speak with union organizers,” wrote Betrand Olotara and Luz Villatoro.

In addition to a $15 wage, “we are demanding a free and fair organizing process just like the one Sen. Bernie Sanders (I-Vt.) is proposing in his Workplace Democracy Act,” they wrote. “Instead of going through a sham election, we should be able to join a union by just signing a union membership card.”

People can show support for the Senate cafeteria workers by signing this petition to “help Senate cafeteria workers form a union to bargain for a living wage.”

Jobless Aid to Get Yet Another Senate Vote as House Continues to Balk

This is the week, that is, that the Senate will once again attempt to pass an emergency unemployment aid extension that House Republicans will refuse to even bring up for a vote. The bipartisan unemployment deal the Senate will be considering has some problems, mostly ones created in the effort to win the final Republican vote needed to break a filibuster, and of course House Speaker John Boehner’s response is to use the problems as an excuse to kill an unemployment extension altogether rather than to look for a fix. A fix should be possible:

Labor Secretary Tom Perez sent a letter to Senate leaders on Friday saying he is “confident that there are workable solutions for all of the concerns raised by [the National Association of State Workforce Agencies]” and that “any challenges pale in comparison to those to the need that the long-term unemployed have for these benefits.”

The Nevada head of unemployment insurance operations said he was ready to implement the bill regardless: “We would stand ready and do it. … We’ll get through it, just like we have in the past.”

Meanwhile, even some Republicans are starting to get openly frustrated with obstruction from their party:

Sen. Dean Heller (R-Nev.), the main Republican working on the deal, said it was “extremely disappointing that, no matter what solution is reached, there is some excuse to deny these much-needed benefits.”

This should not exactly come as a surprise to Heller. There’s always an excuse.

House Democrats are circulating a discharge petition to force a vote on unemployment aid, but so far no Republicans have signed it. Getting a House vote on this vital bill, whether through a successful discharge petition or action by Boehner, will require the kind of public pressure even House Republicans can’t ignore.

Will immigration reform protect workers?

eidelson_100As House Republicans mull maiming the Senate’s immigration bill, a thousand pundits are asking what their moves will mean for future elections. Meanwhile, far from the spotlight, some courageous immigrant workers are asking whether Congress will finally disarm employers who use immigration status to silence employees. If Congress punts on immigration reform, or merely passes an industry wish list, it will have doubled-down on complicity in a little-discussed trend that’s driving down working conditions for U.S.-born and immigrant workers alike: For too many employers, immigration law is a tool to punish workers who try to organize.

The workers watching Congress include Ana Rosa Diaz, who last year was among the Mexican H-2B visa guest workers at CJ’s Seafood in Louisiana, peeling crawfish sold by Walmart. Accounts from workers and an NGOassessment suggest the CJ’s workers had ample grievances, from the manager that threatened them with a shovel, to the worms and lizards in the moldy trailers where they slept, to the swamp fungus that left sticky blisters on their fingers as they raced through shifts that could last twenty hours.
To maintain that miserable status quo, workers allege, management regularly resorted to threats. The most dramatic came in May 2012, when they say CJ’s boss Mike LeBlanc showed up at the start of their 2 a.m. shift to tell them he knew they were plotting against him, and that he knew “bad men” back in Mexico, and to remind them that — through labor recruiters there — he knew where their families lived. Then LeBlanc ticked off some names, including Diaz’s daughter. Diaz told me the threat of violence was all too clear: “I’ve never been so afraid of anybody in my life.”

Long before that speech, CJ’s workers say their managers deployed an all-too-common threat, what they call the “black list”: not just being deported back to Mexico, but being prevented by recruiters there from ever working in the United States again. “That’s what makes us the bosses’ subjects,” Diaz told me in a 2012 interview. “We’ve realized most bosses use the same tactics
” said her co-worker Martha Uvalle. “‘I’ll send you back to Mexico. I’ll report you to immigration. You’ll never come back.’” (CJ’s Seafood did not respond to various reporters’ requests for comment last year, including mine. Efforts to reach the company for comment last week were unsuccessful.)

Guest workers aren’t the only immigrants whose bosses can wield their immigration status as a weapon. Too often, employers who’ve happily gotten rich off the labor of undocumented workers develop a sudden interest in those employees’ legal status once they start speaking up. A few days after three-year subcontracted food court employee Antonio Vanegas joined a strike in the government-owned Ronald Reagan Building, he was detained by Homeland Security and placed in a four-day immigration detention. The same day that workers at Milwaukee’s Palermo’s Pizza plant presented their boss with a union petition, management presented workers with letters stating they’d need to verify their legal status. Ten days later, Palermo’s fired 75 striking workers, arguing it was just following immigration law.

For every immigrant worker that risks retaliation, there are others that choose not to, chastened by a well-founded fear that their status will be used against them. (There’s a risk of retaliationanytime U.S. workers try to exercise workplace rights, but the threat for undocumented or guest workers is particularly acute.) That vulnerability holds back the efforts of unions and other labor groups to organize and transform low-wage industries — or even to ensure employers pay minimum wage to their workers, immigrant or otherwise. It helps explain why the center of gravity in organized labor — long the site of struggles between exclusion and equality — has swung decisively in recent decades to support immigration reform. Rather than pushing to deport immigrants, unions (including my former employer) are mostly trying to organize them. The less leverage employers have over immigrants’ legal status, the more leverage immigrant and U.S.-born workers will have to wrest dollars and dignity from their bosses together.

The Senate’s immigration bill takes a few key steps to make that easier, each of which activists expect will face strong opposition in the House. The bill features a path to citizenship that organizers expect will help disarm deportation-happy bosses by allowing millions of workers to obtain secure and equal legal status. It creates a new “W visa” program with more labor protections that advocates hope will become a template to someday replace existing guest worker programs like the H-2B. And the bill includes several anti-retaliation measures designed to stem abuse: from more chances for workers who exposed crimes to get special visas or stays of deportation, to language overturning a Supreme Court decision that prevented illegally fired undocumented workers from getting back pay.

Those pro-labor provisions already come with painful sacrifices. Even before the Senate pegged it to a militarized “border surge,” that path to citizenship was long and littered with obstacles. Those include a requirement of near-continuous employment that advocates warn could still leave immigrants especially vulnerable to retaliatory firings, and an exclusion based on criminal convictions that — combined with a mandate that employers use the controversial status-checking software e-Verify — could leave some workers more vulnerable than ever. And advocates note that the H-2B program could at least temporarily more than double in size during the bill, though it would be subject to some modest new protections.

Facing a hostile House, labor officials are framing those Senate compromises as a floor for labor language in immigration reform: “There can be no further erosion of rights, and we’re protecting that as it goes to the House,” says Ana Avendaño, the AFL-CIO’s Director of Immigration and Community Action. But the Senate provisions are more likely to be treated as a ceiling. “We’ll lose all of the worker protection stuff in the House,” said a different advocate working on immigration for a union, and then “hope that reason prevails in the conference” committee tasked with reconciling Senate and House legislation.

The CJ’s Seafood story has an unusual ending: After their boss’s implied threat to their families, Diaz and seven of her co-workers mounted an against-the-odds strike. “We felt,” Diaz told me, “that if we didn’t do something to stop this, sometime in the future, it would be our children going through it.” You won’t find much such courage in Congress.
