On May Day, Working People Across Borders Are United to Build Power

Throughout North America and globally, May 1 is a day to remember and respect workers’ rights as human rights. As working people take to the streets in communities around the world, a quieter but equally important movement of workers on both sides of the United States–Mexico border has been growing.

Whatever language we speak and wherever we call home, working people are building power, supporting labor rights and fighting corruption—and we’re doing it together.

Our agenda is simple. We oppose efforts to divide and disempower working people, and we oppose border walls and xenophobia anywhere and everywhere. We want trade laws that benefit working people, not corporations. And we want economic rules that raise wages, broaden opportunity and hold corporations accountable.

Nearly 20 years ago, many independent and democratic Mexican unions began an alliance with the AFL-CIO.

We’ve developed a good working relationship. We’ve engaged in important dialogue and identified shared priorities. Now we are ready to take our solidarity to the next level, turning words into deeds and plans into action.

You see, we believe no fundamental difference exists between us. We share common values rooted in social justice and a common vision of the challenges before us.

The corporate elite in the United States and Mexico have been running roughshod over working people for too long. Corporate-written trade and immigration policies have hurt workers on both sides of the border.  We each have experienced the devastation caused by economic rules written by and for the superrich.

Those of us in the United States can see how unfair economic policies have destroyed Mexico’s small farms and pushed many Mexicans to make the perilous trek north or settle in dangerous cities. Many in Mexico are worried about their own families, some of whom might be immigrants in the United States today. Workers in the United States share their concern, especially as anti-immigrant sentiment has become disturbingly mainstream.

The truth is more and more politicians are exploiting the insecurity and pain caused by corporate economic rules for political gain by stoking hatred and scapegoating Mexicans and other Latin American immigrants.

We will not be divided like this. Workers north and south of the border find the idea of a border wall to be offensive and stand against the criminalization of immigrant workers. We need real immigration reform that keeps families together, raises labor standards and gives a voice to all workers.

Instead of erecting walls, American and Mexican leaders should focus on rewriting the economic rules so working people can get ahead and have a voice in the workplace. One of our top priorities is to transform trade deals like the North American Free Trade Agreement into a tool for raising wages and strengthening communities in both countries.

We’re outraged by the kidnapping and murder of the 43 students from the Ayotzinapa Rural Teachers’ College, as well as too many other atrocities to list.

America’s unions are democratic in nature and independent of both business and government, but that’s mostly not true in Mexico. A key step in ending violence and impunity in Mexico and raising wages and standards on both sides of the border is to protect union rights and the freedom of association in Mexico.

We’re united. We’re resolute. We are ready to win dignity and justice for all workers.

In the Wake of Deadly Clashes, AFL-CIO Stands with Mexican Teachers Union

charlie fanningAt least eight protesters were killed and 53 injured earlier this week in clashes with police in Oaxaca, Mexico, during demonstrations against neoliberal education reforms. The teachers union in Oaxaca has been leading protests this summer against the federal government’s move to impose a national education plan that blankets over indigenous concerns in Oaxaca and imposes teacher evaluations that disadvantage schools in the poor region, as well as attacks against the union, including the controversial arrests of union leaders, mass firings of protesting teachers and the freezing of union bank accounts.

On Sunday, police sought to break up a blockade of protesters and violence erupted, with reports of police shooting into the crowd. The recent tragedy is another in a long line of incidents in Mexico’s ongoing human and labor rights crisis, including the 2014 disappearance and murder of 43 students from the teachers college in Ayotzinapa at the hands of local police and criminal gangs.

AFT President Randi Weingarten has called for an end to the violence and the immediate start of productive negotiations, and described the situation as “a sad commentary on human rights when a government meets union concerns with deadly force.”

 Talks have begun between union officials and the government, as teachers in Oaxaca continue their protests despite police threats. The AFL-CIO stands with teachers and their families in Oaxaca in their struggle for justice and autonomy.

Further, as the U.S. and Mexican governments continue to push for expanded trade benefits under the Trans-Pacific Partnership, the AFL-CIO and Mexican unions oppose the agreement and demand that the Mexican government—and other countries with dire human and labor rights records like Vietnam and Malaysia—undertake fundamental reforms to end impunity for human rights abuses and protect freedom of speech, association and labor rights.

Trade Deals Like TPP Encourage ‘Business Decisions’ Like This Heartbreaking One from Indianapolis

In this video, workers at the Carrier plant in Indianapolis react to the company announcing that it will ship 1,400 local jobs to Mexico in what they described as “strictly a business decision.” You can hear the heartbreak and outrage in the voices of the workers who must now scramble to figure out how to take care of their families. Carrier makes heating, air conditioning, ventilation and other systems. The layoffs are scheduled to begin in 2017.

Aside from corporate greed, the main reason that Carrier can get away with something like this is the major flaws that have been built into international trade deals like North American Free Trade Agreement and the Trans-Pacific Partnership. These kinds of deals make sure that these types of tragic moments happen more frequently.

First off, these deals provide companies that want to offshore to trading partners with extraordinary powers and legal rights they do not have under U.S. law–powers and rights that shift the balance of power further away from working people. Second, these deals put U.S. manufacturers in closer competition with foreign companies that pay low wages and don’t respect labor rights. This encourages U.S. companies to offshore in order to keep up with those foreign companies.

The third reason these deals encourage outsourcing is that they fail to level the playing field in terms of taxes. Such a deal could set a minimum level for corporate tax rates or create rules to prevent companies from gaming the tax system and pitting countries against each other. With those options left off the table, a race to the bottom is encouraged, where companies shift jobs to countries with lower tax rates, which, in turn, encourages higher-tax rate countries to lower taxes and the ripple effect those lower rates have on the economy and the government’s goods and services. A trade deal meant to create U.S. jobs would address this.

And lastly, of course, these trade deals eliminate tariffs in the trade zone, further encouraging companies to shift jobs to trade partners because corporations know they can ship goods back into the United States without paying tariffs, thus using the tariff cuts to increase U.S. imports instead of increasing U.S. exports.

On Both Sides of the Border, Teachers Fight Corporatization

Last month, the success of the Chicago teachers’ strike forced the mainstream media to present a rare picture of public school teachers: as organized, defiant and victorious. But prior to the Chicago teachers winning a major deal, there was no shortage of dismissive, condescending and misleading coverage of teachers unions.

Recently, that disdainful media gaze has turned southward. Various outlets–public radio, USA Today, McClatchy, the Economist and Washington Post–have depicted the Mexican teachers union as a sinister force in the national struggle over public education policy. The reports generally focus on Mexico’s poor academic performance in international rankings and zero in on the “boss” of the National Education Workers’ Union (SNTE), Elba Esther Gordillo, who is cartoonishly portrayed as an authoritarian collector of fancy handbags.

A June Washington Post report on Mexico’s crumbling schools, published on the eve of a landmark national election, said, “Twenty percent of the country’s budget goes to education, about $30 billion a year. More than 90 percent goes to salaries–negotiated by the teachers union, which dictates policy.” The piece quotes education scholar Carlos Ornelos of the Autonomous Metropolitan University about the alleged black market in teaching jobs: “The group Mexicans First estimates that 40 percent of the teaching jobs are still sold, or inherited, or exchanged for political or even sexual favors.” Yikes.

The source Ornelos cites, Mexicanos Primero, is a think tank that seems to closely align its politics (and name) with high-power U.S. reform groups like Students First. In the vein of “Won’t Back Down”, Mexicanos Primero has sponsored its own cinematic screed on teachers, “¡de Panzazo!” (“barely passing”), depicting corruption and incompetence throughout Mexico’s education system.

Both ¡de Panzazo!’s claims and the American press’s disdain for Mexico’s teachers show only one sliver of a complex, often misrepresented political context. Yes, there is documented evidence of rampant corruption as well as [certain] persistent cronyistic practices in the Mexican teachers union, such as reserving teaching positions for family members. But that’s not the whole story.

In both Mexico and the United States, schools are an ideological battleground. Corporate-minded school-reform groups such as Mexicanos Primero and Students First promote curbing teachers’ unions, tiering their pay schemes, and running schools more like businesses in an educational “marketplace.”

To suggest that unions are primarily driving Mexico’s educational challenges is to echo the corporate reformers in the U.S. that pit “unions” against “reform”. This myopic mentality misses the fact that educational policy reflects the priorities of the political class while silencing communities and thus masking the underlying crises that affect educational achievement.

In fact, rank-and-file teachers are often at the helm of movements for real educational equity. Dissident members of SNTE, known as Coordinadora Nacional de Trabajadores de la EducaciĂłn (CNTE), have actively challenged authoritarian union officials, and at the same time resisted hardline reforms they see as corrosive to a democratic, broad-based education. They’ve also mobilized against sweeping new neoliberal labor legislation.

Reporting on teacher protests last year in Oaxaca (the site of a mass uprising in 2006) Dan LaBotz noted that the dissident educators demonstrated not only against education authorities’ plans to impose a controversial national exam system, but also against Gordillo’s rule:

Teachers blockaded government offices and private companies, closed major intersections, and “liberated” the toll booths on the privately owned highway to Mexico City. They also attempted to shut down the airport….

The Oaxaca teachers are making no new wage demands. They insist, however, that the Oaxaca state government install computers in all elementary schools and pay the schools’ electric bills. According to union spokespeople utility bills are currently paid by parents.

In a statement on CNTE’s blog posted in August, the group called the reform agenda an assault on the government’s obligation to provide free basic public education. Also the CNTE calls the standardized testing system “an insult to the economic, cultural and social development of our country because [of] deepened inequality of schools, students and teachers.”

Marco Fernandez, an education scholar who has written on education and union reform, says that dissident-led strikes and protests hurt more than help. “I cannot see how the teachers’ absenteeism and strikes [will lead to] the quality of education that a kid needs… for eventually getting a good job,” he says. When labor disputes lead to disruptive actions that upend schooling and testing, he argues, “The ones that in the long run pay the consequences are the kids. And this is a tragedy.”

Yet some see corruption baked into the core of education policy. Educational researcher Manuel Gil-AntĂłn of the College of Mexico, publicly warned that authorities might aggravate persistent educational inequities and that the official reforms might lead to “manipulating the data and an unjustified triumphalism.”

Longtime labor journalist David Bacon, who has tracked cross-border solidarity movements, tells Working In These Times that in the school reform debate in Mexico, as in the U.S., tends to zero in on teachers while ignoring deeper social deficits; one key problem is simply that schools are deeply underresourced and many families simply can’t afford education. In the long run, he says, “These are social problems that you can’t cure with an educational system… You need a fundamental social change in Mexico, a part of which would be making everybody literate. But you can’t make everybody literate in the absence of other changes that are gonna happen in their lives.”

Bacon sees teachers not only as political actors, but bearers of a progressive tradition in Mexico:

If you go into little towns in Mexico out in the countryside, teachers are community leaders… in very large part, they are also the repositories of progressive values and ideas. So if you talk to Mexican workers, people will use words like “capitalism,” and “the working class,” and even “socialism,” and it’s because there are teachers who are giving this understanding to their students.

While many Americans may write off Mexico and its schools as “Third World” bastions of corruption, teachers’ resistance to neoliberal reforms is a striking parallel to the school labor dramas in Chicago and across the United States. Maybe rank-and-file educators in Oaxaca and Chicago can exchange best practices on how to take their fights outside the classroom and bring a lesson in solidarity to the streets.

First NAFTA-Wide Union Could Emerge This Year

In Mexico, few independent union exist that are not effectively controlled by the Mexican government. According to United Steelworkers International Affairs Director Ben Davis, fewer than 1 percent of Mexico’s unions are truly independent unions. As a result of the lack of independent unions in Mexico, Mexican workers have had a very hard time advocating for higher wages. Further, those unions that are independent in Mexico—like the National Union of Mine, Metal, Steel and Related Workers of the Mexican Republic, aka Los Mineros—have faced severe oppression at the hands of government-affiliated unions.

In 2006, Los Mineros President Napoleon Gomez Urrutia was forced to flee to Canada after the Mexican government charged him with what union officials characterize as trumped-up charges of embezzlement. A federal Mexican court has dismissed the charges against Gomez Urrutia, but the charges against him remain pending at the state level. Supporters of the exiled labor leader says that he was only charged with crimes after he demanded an investigation of 2006 mine explosion that killed 65 workers at the Pasta de Conchos. Gomez Urrutia has been running the 180,000-member Los Mineros union out of the Steelworkers’ District 3 offices in Burnaby, British Columbia.

Despite the charges against Gomez Urrutia and his forced exile, his continued relevance was demonstrated late last week when officials for the Mexican operations of steel corporation ArcelorMittal traveled to Toronto to negotiate with the exiled Mexican labor leader. The trip was made possible in part through the assistance of the United Steelworkers (USW), who may merge with Los Mineros later this year.

Last month, In These Times Contributing Editor Kari Lydersen profiled how the unique cross-border solidarity emerged between USW and Los Mineros. In 2005, steelworkers went out on strike at an Asarco owned copper mining and smelting mill in Arizona in 2005. Many Mineros members who work at the Grupo Mexico company, which owns Asarco, went out on strike and performed other solidarity actions in support of striking miners in Arizona.

As a result of that strike, a solidarity agreement was formed between those two unions in 2005. In 2010, USW and Los Mineros formed a joint commission to look at merging their two unions. According to United Steelworkers Public Affairs Director Gary Hubbard, the joint commission is working toward a  unification proposal for discussion at the Steelworkers’ convention in August in Las Vegas.

As Kari Lydersen noted, “If the merger occurs, the new USW-Mineros union would represent more than 1 million workers—the USW has 850,000 members, while the Mineros has 180,000.”

If the USW/Los Mineros merger passes, as many expect it will, it would be the first between a Mexican-based union, an American affiliate of a union and a Canadian affiliate of a union—marking a new phase of cross-border solidarity. The merger has the potential to reshape labor markets in both countries.

“We are directly affected everyday by the low-wage competition from Mexico. The reason that competition is low-wage is because Mexican government keeps wages low by busting unions,” says USW International Affairs Director Ben Davis. “It’s a matter of survival for us to have democratic unions that support workers’ rights and raise wages. It’s really about closing the gap the right way by bringing Mexican wages up, not our wages down, through strengthening alliances between workers who quite often have the same employers.”

Correction: The original version of this article stated that members of both USW and Los Mineros would vote on a unification proposal if it were part of USW’s August convention. In fact, only USW members can vote on proposals presented at the convention.

Mexico’s Mineros to Receive Meany-Kirkland Award

Image: James ParksOver the past five years, the Mexican government has unleashed a systematic attack on workers’ rights. Despite the continuing repression, Mexico’s independent, democratic unions organize and represent the rights of workers. Some of the most egregious attacks have been on the Mine, Metal and Steel Workers Union (SNTMMSSRM), also known as Los Mineros.

The AFL-CIO Executive Council, meeting in Washington, D.C., last week, awarded Los Mineros and their leader, Napoleón Gómez Urrutia, the 2011 George Meany-Lane Kirkland Human Rights Award. The award will be formally presented later this year.  Click here to read the resolution in English and here for Spanish.

Gómez was first elected general secretary of the SNTMMSSRM in 2002 and immediately began challenging government policies of low wages and flexible labor markets, and building alliances with the global trade union movement.

When a February 2006 explosion at Grupo Mexico’s Pasta de Conchos mine killed 65 mineworkers, Gómez publicly accused the government of “industrial homicide.” In response to this criticism, the government filed criminal charges against Gómez and other union leaders, froze the union’s bank accounts, assisted employers to set up company unions in SNTMMSSRM-represented workplaces and declared the union’s strikes illegal and sent in troops to suppress them.

Four union members were murdered and key union leaders were jailed. In the face of this campaign of repression, Gómez left Mexico for Vancouver, Canada.  From there he has waged a five-year effort to win justice for his union and for all democratic unions in Mexico.

Despite massive repression, the SNTMMSSRM has continued to bargain contracts and organize new workplaces with the help of trade union allies around the world.

Gómez has won major legal victories. Mexican courts have thrown out all of the criminal charges against him and rejected the government’s appeals.

The annual Meany-Kirkland award, created in 1980 and named for the first two presidents of the AFL-CIO, recognizes outstanding examples of the international struggle for human rights through trade unions. Previous winners have included Wellington Chibebe of Zimbabwe, Ela Bhatt, the founder of India’s Self Employed Women’s Association, the Liberian rubber workers, Colombian activist Yessika Hoyos and the Independent Labor Movement of Egypt.

He saw firsthand how companies pull out all the stops to prevent workers from forming a union.
