Did You Vote For Unfair Pay and Unsafe Workplaces?

Who could be against fair pay and safe workplaces? Give you one guess.

President Trump just signed a bill, passed by the Republicans in the House and Senate, that repealed President Obama’s Fair Pay and Safe Workplaces executive order.

“Fair pay and safe workplaces” says it all. The rule stated that our government should contract with companies that have “a satisfactory record of integrity and business ethics.”

It required companies to report if the had violations of workplace laws covering wage theft, discrimination and safety, when applying for new government contracts of $500,000 to $1 million. The federal procurement officers would take that into consideration, and work with the companies to remedy the problems.

That is what President Trump and the Republicans repealed. This Trump/Republican government does not care if companies that have “a satisfactory record of integrity and business ethics.” In fact, repealing this rule signals to companies that it is OK to “save money” by stealing pay from employees, violating their civil rights and threatening their safety.

This rule was a big deal, because companies that get federal contracts employ one in five American workers.

This is the Republicans, not just Trump. This is who they are.

But, of course, the “working class” voters who helped elect Trump and the Republicans all voted for this, right? They all clearly understood that electing Republicans meant that their pay and civil rights and job-safety were going to be rolled back so that the giant corporations could pass ever-higher profits to their “investors.” Right?

Of course they did. And they understood that the things our government does to make our lives better would be rolled back so that investor class could get huge tax cuts. Right? Of course they did.

But wait, there’s more.

The Occupational Health and Safety Administration’s (OSHA) “recordkeeping rule” is also under the gun. This rule requires employers with more than 10 workers to keep records of safety incidents for five years. The Republicans in the Senate voted last week to gut that rule, too.

UAW President Dennis Williams called it “a slap to the face of American workers” and urged Trump to veto it. Williams said if employers can legally dispose of incident records after six months, “it will be extremely difficult to identify and fix hazards and incident patterns that cause illnesses, severe injuries, or even deaths on the job.”

“It will now cross the desk of President Donald Trump, who is expected to sign it.”

But this is only right, because this is clearly what the country voted for. Right?

Five Groups of Americans Who’ll Get Shafted Under Trump’s Hiring Freeze

RichardEskowDonald Trump, in what’s been hyped as an “unprecedented” move, has instituted a freeze on the hiring of federal employees. Hyperbole aside (it’s hardly unprecedented, since Ronald Reagan did the same thing on his first day in office), one thing is already clear: this will hurt a lot of people.

Trump’s order exempts military personnel, along with any position that a department or agency head “deems necessary to meet national security or public safety responsibilities.” That offers a fair degree of latitude when it comes to filling positions in certain areas.

But Trump’s appointees aren’t likely to ask for “national security or public safety” exemptions for the many government jobs that help people in ways Republicans despise. So who stands to lose the most under this hiring freeze?

1. Social Security Recipients

Trump and his advisors seem to have had Social Security in mind when they included this language:

“This hiring freeze applies to all executive departments and agencies regardless of the sources of their operational and programmatic funding …” (Emphasis mine.)

While there may be other reasons for this verbiage, it effectively targets Social Security, which is entirely self-funded through the contributions of working Americans and their employers.

Social Security is forbidden by law from contributing to the deficit. It has very low administrative overhead and is remarkably cost-efficient when compared to pension programs in the private sector.

That hasn’t prevented Republicans in Congress from taking a meat cleaver to Social Security’s administrative budget. That has led to increased delays in processing disability applications, longer travel times for recipients as more offices are closed, and longer wait times on the phone and in person.

Social Security pays benefits to retired Americans, disabled Americans, veterans, and children – all of whom will be hurt by these cuts.

2. Working People

The Department of Labor, especially the Occupational Health and Safety Administration (OSHA), ensures that working Americans are safe on the job. It’s a huge task: Nearly 2.9 million Americans were injured on the job in 2015, according to OSHA data, and another 145,000 experienced a work-related illness. 4,836 people died from work-related injuries in 2016. (These numbers count only reported injuries, illnesses, and deaths; not all are reported.)

OSHA’s employees study injury and illness patterns, communicate safety practices and rules, and inspect workplaces to make sure that the rules are being followed. This hiring freeze will lead to fewer such studies, communications, and inspections. That means working Americans will pay a price — in injury, illness, and death.

3. Veterans

Some 500,000 veterans have waited more than a month to receive medical care from the Veterans Administration. Nevertheless, White House spokesperson Sean Spicer confirmed that Trump’s hiring freeze will affect thousands of open positions at the VA, including positions for doctors and nurses. The nation’s veterans will pay for this freeze, in prolonged illness, injury, and pain – or worse.

Vets will pay in another way, too. Vets make up roughly one-third of the federal workforce, which means they will be disproportionately harmed by this hiring freeze. So will women and minorities, both of whom have a significant presence among federal workers – greater than in the workforce as a whole.

4. Small Businesses and Workers All Across the Country

Contrary to what many people believe, federal employees are work in offices all across the country. The goods and services purchased by each federal worker provide jobs and growth for their local economies. Cuts in the federal workforce will therefore cause economic damage all of the states where federal jobs are located.

According to the latest report on the subject from the Office of Management and Budget, states with the largest numbers of Federal employees are: California, with 150,000 jobs; Virginia, with 143,000 jobs; Washington DC, with 133,000 jobs; and, Texas, with 130,000 jobs.

That’s right: Texas.

Other states with large numbers of Federal employees include Maryland, Florida, and Georgia.

Demand for goods and services will fall with the federal workforce. So will demand for workers, which means that wages will rise more slowly (if at all). This hiring freeze will affect small businesses and working people in states like Texas and all across the country.

5. Everybody Else.

The “public safety” argument could also be used to exempt employees of the Environmental Protection Agency from the hiring freeze. But Trump has nominated Scott Pruitt, a longtime foe of environmental regulation who has sided with some genuinely noxious polluters, to run the EPA.

As Oklahoma’s Attorney General, Pruitt has sued the EPA 14 times. “In 13 of those cases,” the New York Times reports, “the co-parties included companies that had contributed money to Mr. Pruitt or to Pruitt-affiliated political campaign committees.”

In other words, Pruitt is dirty. It’s unlikely he’ll seek a “public safety” exemption for the inspectors that identify industrial polluters and bring them to justice. So another group that will suffer under this freeze, without getting too cute about it, is pretty much anybody who drinks water or breathes air. That covers just about everybody.

And that’s just the beginning.

This is not an all-inclusive list. We’ve left out tourists, for example, who’ll pay the price for staffing cuts at the nation’s monuments and national parks. But the overall impact of Trump’s hiring freeze is clear: it shows a reckless disregard for the health, safety, and well-being of the American people.

(And that’s not even counting his plan to end the Affordable Care Act. Physicians Steffie Woolhandler and David Emmelstein estimate that this will result in 43,000 deaths every year. And they’re not Democratic partisans or ACA apologists; they’ve been fighting for single-payer healthcare for years.)

Given these implications – and the thousands of jobs affected at the VA alone – it was surprising to read, in Politico, that “Trump’s move, by itself, doesn’t actually do much.”

That’s true, in one way. The 10,000 to 20,000 jobs affected by this freeze pale in comparison to the federal government’s total workforce of 2.2 million.

But Trump’s just getting started. His memo instructs the Director of the Office of Management and Budget to come up with a broader long-term plan for reducing the federal workforce through attrition. And Trump’s choice for that job, Rep. Mick Mulvaney, is a far-right Republican who’s been fighting to cut the federal government for years.

This freeze is a bad idea, but there will be more where this came from.

Trump’s war on EPA regulations will kill jobs and a lot of people

In his first days in office, President Donald Trump has launched a major effort to hurt job growth, stifle innovation, and make Americans sicker and less productive. How? By waging war on regulations, particularly those designed to protect the environment.

Trump ran on a pledge to kill regulations, and focused much of his wrath on EPA climate rules such as the Clean Power Plan. Upon assuming office, he put in place a “freeze” on all federal regulations; told business leaders “we’re going to be cutting regulation massively” by 75 percent or “maybe more”; and told car company executives that environmental regulations are “out of control.”

Yet, contrary to popular myth, regulations such as clean air and water standards do not have a net negative impact on job growth. Indeed, studies have found that the exact type of regulations Trump is targeting actually spur innovation and competitiveness.

As Bureau of Labor Statistics data make clear (above chart), the recent two-term presidents who were in favor of regulation, especially environmental regulation (Obama and Clinton) created vastly more net jobs than the anti-regulation Presidents (Reagan and George W. Bush). “Businesses have added jobs at a nearly 2.5 times faster rate under Democrats than under Republicans, on average,” the U.S. Congress Joint Economic Committee reported in June.

The multiple economic benefits of regulations are well documented. First, EPA regulations make companies invest money to reduce some of the damage that results from their operation— such as polluting the air or water. That investment directly creates jobs, which generally cancel out any jobs lost by the cost imposed on the polluters.

Second, the reduction in harm itself boosts growth—cleaner air, for instance, means fewer sick days lost to asthma or cardiopulmonary illness. Here, for instance, are the health and mortality benefits of EPA Clean Air Act programs since 1990 aimed at reducing fine particles and ozone levels:

EPA particulate regulations (PM2.5) alone are now saving some 200,000 lives a year. And the benefits to the economy of these health improvements are enormous. The loss in economic output due to restricted activity, sickness, and death is enormous.

Indeed, the 2016 “Draft Report to Congress on the Benefits and Costs of Federal Regulations” by the Office of Management and Budget found that over the previous 10 years, EPA’s air regulations cost the economy $41 to $48 billion (in 2014$) while providing benefits worth $172 to $668 billion.

The same report found that Energy Department efficiency standards—which Trump has also frozen—cost the economy $7.5 to $10.6 billion but provided $19 to $32.6 billion in savings. And it found that the joint EPA and Transportation Department “rules pertaining to the control of greenhouse gas emissions from mobile sources and improved vehicle fuel economy” had costs of $9.5 to $18 billion and benefits worth $35 to $64 billion.

Third, beyond those direct costs and benefits, environmental regulations spur innovation. This was the key notion that Harvard Business School professor and competitiveness guru Michael Porter first suggested in the 1990s. Subsequent reviews of the economic literature on the so-called “Porter Hypothesis” confirmed he was right. Indeed, the most recent studies confirm Porter’s broader theory that “stricter regulation enhances business performance.”

It’s worth noting that a comprehensive peer-reviewed analysis of the performance of the U.S. economy in the past six decades found that “growth in total factor productivity was much faster under Democrats (1.89 percent versus 0.84 percent for Republicans).” So if anyone’s policies are hurting productivity, it would appear to be the GOP’s.

Finally, in the coming decades, the ever-worsening reality of climate change will ensure that the primary new manufacturing jobs will be green and sustainable. In 2010, the New York Times reported “in the energy sector alone, the deployment of new technologies, like wind and solar power, has the potential to support 20 million jobs by 2030 and trillions of dollars in revenue, analysts estimate.”

The Paris climate deal—unanimously agreed upon by 190 nations in December 2015—means that the potential revenues generated for cleantech in the coming decades will be measured in the tens of trillions of dollars.

This potential is quickly becoming a reality. Other countries, especially China, have used regulations and investment to become leaders in clean energy technologies like solar and wind. And now China is using the same strategy with batteries and electric vehicles (EVs) to capture what is projected to be an EV market of more than 37 million in 2025.

But Trump intends to kill the very policies and regulations that would give the U.S. a piece of what is becoming the largest collection of new job-creating industries.

So, tragically, Trump’s war on regulations will not only kill countless U.S. jobs, it will kill a lot of people.

Workers Say Trump’s Labor Secretary Nominee Is a Habitual Violator of Labor Law

Andrew Puzder, Donald Trump’s nominee for labor secretary, is uniquely unqualified for that job. As secretary, he’d be charged with enforcing health and safety, overtime and other labor laws. But as CEO of CKE Restaurants, the parent company of Hardee’s and Carl’s Jr., he’s made his considerable fortune from violating these very same laws, according to a report by the Restaurant Opportunities Centers (ROC) United released this week.

ROC, which advocates for restaurant workers nationwide, surveyed 564 CKE workers, 76 percent of them women. In discussing the results of the survey, it’s important to note that while ROC surveyed a large number of workers, the respondents are people who chose to fill out a survey distributed by a workers’ rights organization, which they learned about through their social media networks. Still, ROC reported “unprecedented” interest in the survey among workers at CKE and their eagerness to be part of the study, and the experiences they reported, are striking reminders that by tapping Puzder, Trump has made clear that his administration will be a dystopian nightmare for U.S. workers.

A recent national survey among non-managerial women working in fast food found that 40 percent of such women have experienced sexual harassment on the job. Under Puzder, the problem could worsen: A whopping 66 percent of female CKE workers ROC surveyed had faced sexual harassment. Harassment came from supervisors, co-workers or—most often—customers, and took the form of sexual comments, groping, unwanted sexual texts and pressure for dates.

CKE is known for its sexist advertising, which depicts women in skimpy bikinis devouring cheeseburgers. And, certainly, imagery contributes to the culture, but when harassment is as pervasive as it appears to be at CKE, there are usually more structural problems at play. Companies in which women are harassed are generally places in which women—indeed, workers in general—are not valued or respected, and in which workers lack any institutional means to stand up for their rights.

In such companies, women are often not paid and promoted fairly. And, as one might expect, nearly one in five of the CKE workers ROC surveyed said he or she had faced discrimination at work, most commonly on the basis of gender, age or race.

Of the CKE employees who participated in the ROC survey, nearly one-third said they did not get meal breaks that are mandated by law; around one-fourth had been illegally forced to work off the clock or had timecards altered; almost one-third had been illegally deprived of overtime pay.

The ROC survey also found widespread health and safety violations. Nearly one-third of those surveyed said they had become sick or injured on the job. Workers described an environment of slippery floors, frequent grease burns and many said they had to do dangerous tasks—like cleaning a hood over a hot char broiler, for instance—without proper protective equipment.

Appointing Puzder as labor secretary is like inviting Tony Soprano to serve as attorney general. Let’s hope this enemy of working people will face humiliation and defeat when his confirmation goes before the Senate. His hearing, originally set for next Tuesday, may now be postponed until February. That delay would give labor—meaning anyone who works for a living—more time to mobilize against him. Let’s get started.

Trump Nominates Non-Free-Trader Robert Lighthizer to Trade Office

President-“elect” Donald Trump today announced his nomination of Robert Lighthizer for the cabinet-level office of US Trade Representative (USTR). Lighthizer, who served as deputy USTR under President Ronald Reagan, is known for criticizing Republican “free trade” ideology. Before serving in the Reagan administration he was chief of staff for the Senate Finance Committee.

Lightizer’s nomination signals that Trump is likely to oppose the wide-open “free trade” ideology and policy that ruled the last several decades, enriching the Wall-Street “investor” class while wiping out US-based industries like textiles and electronics manufacturing, devastating entire regions and communities like the “Rust Belt” and Detroit, as well as much of the American middle class.

But Lightzinger and Trump’s public positions are at odds with most of Trump’s nominees to other positions, most Republicans in Congress and with the billionaires, “investors” and giant corporations that usually line up behind and fund the Republican party. How will Trump handle the expected opposition from these elements of the Republican coalition? If Trump would give a press conference perhaps we could know more.

Meanwhile, according to Fox News, Trump said,

“Ambassador Lighthizer is going to do an outstanding job representing the United States as we fight for good trade deals that put the American worker first,” Trump said Tuesday in a statement announcing his pick. “He has extensive experience striking agreements that protect some of the most important sectors of our economy, and has repeatedly fought in the private sector to prevent bad deals from hurting Americans. He will do an amazing job helping turn around the failed trade policies which have robbed so many Americans of prosperity.”

Reuters reports that Lightizer has been fighting China’s unfair trade practices,

Lighthizer has argued that China has failed to live up to commitments made in 2001 when it joined the World Trade Organization and that tougher tactics are needed to change the system, even if it means deviating from World Trade Organization rules.

“Years of passivity and drift among U.S. policymakers have allowed the U.S.­-China trade deficit to grow to the point where it is widely recognized as a major threat to our economy,” Lighthizer wrote in 2010 congressional testimony.

“Going forward, U.S. policymakers should take these problems more seriously, and should take a much more aggressive approach in dealing with China,” he wrote.

Lori Wallach Statement

Lori Wallach, director of Public Citizen’s Global Trade Watch, issued a statement on the expected nomination, and noted that it contrasts with most of Trump’s appointments so far, who have been public supporters of the Trans-Pacific Partnership (TPP) that Trump campaigned against,

“Lighthizer is very knowledgeable about both technical trade policy and the ways of Washington, but what sets him aside among high-level Republican trade experts is that for decades his views have been shaped by the pragmatic outcomes of trade agreements and policies rather than fealty to any particular ideology or theory. I don’t know that he would agree with progressive critics of our status quo trade policies about alternative approaches, but he also has had quite a different perspective on trade policy than the Republican congressional leaders and most of Trump’s other cabinet nominees who have supported the TPP and every past trade deal.”

Public Citizen’s press release continued,

President-elect Donald Trump has filled many top administration posts with proponents of the Trans-Pacific Partnership (TPP), a pact that Trump railed against during his campaign. Trump appointees who publicly advocated for the TPP include Wilbur Ross (Secretary of Commerce), Exxon Mobil CEO Rex Tillerman (Secretary of State), Gov. Terry Branstad (Ambassador to China), Gen. James Mattis (Secretary of Defense) and Goldman Sachs President Gary Cohn (Director of National Economic Council) – not to mention Vice-President-elect Mike Pence.

“Thankfully there was never a congressional majority for the TPP in the 10 months after it was signed so the TPP was dead before the election,” said Wallach. “But even so, most of Trump’s cabinet members will be inclined to grab the shovel from Trump’s hands before he can bury the TPP’s moldering corpse by formally withdrawing the U.S. as a signatory.”

Other prominent TPP supporters nominated to join the Trump administration include:

· Rep. Ryan Zinke – Supporter of Fast Track for TPP named Secretary of Interior

· Dr. Ben Carson – TPP supporter named Secretary of Housing and Urban Development
· Elaine Chao – TPP supporter named Secretary of Transportation
· Mike Pompeo – TPP supporter named CIA Director

Scott Paul: “A Great Pick”

Scott Paul, President of the Alliance for American Manufacturing (AAM), issued a statement saying,

“Robert Lighthizer is a great pick for U.S. Trade Representative. I am hopeful he will use his new role to continue to stand up for American workers and manufacturers who have been hurt by unfair trade.

“Mr. Lighthizer fought to secure antidumping and countervailing duties against foreign companies who were flouting U.S. trade law. This leveled the playing field for U.S. workers and saved middle class jobs. He also worked to open overseas markets for U.S. companies and served as a deputy U.S. trade representative during the Reagan administration — experience that will serve him well in his new role.

“Mr. Lighthizer’s selection as USTR — as well as that of Commerce Secretary nominee Wilbur Ross and Peter Navarro, the director of the new White House National Trade Council — is hopefully a signal that the incoming Trump administration intends to take on trade cheats like China, but the proof is always in the policy.”

Friends of the Earth: Lighthizer No Friend Of The Earth

Friends of the Earth Senior Trade Analyst Bill Waren isn’t so sure this is a good nomination:

Trump’s selection of Robert Lighthizer, a corporate lawyer and Republican political operative, to serve as the U.S. Trade Representative is another example of the revolving door between corporate lobby shops on K Street and the White House staff. Nothing in Lighthizer’s background suggests that he has any concern about the environmental and climate havoc resulting from trade deals like the pending Trade in Services Agreement. To the contrary, his clients include big oil, corporate agriculture, big pharma, and the insurance industry.

Lighthizer might be described as a paleo-conservative, in other words a throwback to another era. He is an admirer of the isolationist Robert A. Taft and the racist Jesse Helms. He will fit right in to the xenophobic culture of the Trump administration.

We’ll See

Trumps appointments have been sending mixed signals and Trump has been giving the public very little information on what to expect from his administration (and refusing to hold press conferences). But at least so far his trade appointments give the appearance of lining up with his campaign promises.

But watch out for this: Trump Trade Position Is Opposite Of What People Think It Is.

Trump falsely claims he created thousands of new jobs, and news outlets lap it up

It was a huge announcement. An announcement so full of winning that we may even get tired of winning.

“Because of what’s happening and the spirit and the hope,” President-elect Donald Trump told reporters on Wednesday, “I was just called by the head people at Sprint and they’re going to be bringing 5,000 jobs back to the United States.”

And just in case there’s any doubt about who deserves credit for these jobs, Trump was happy to take it. “I just spoke with the head person,” Trump claimed, “he said because of me they’re doing 5,000 jobs in this country.”

There’s just one problem. It’s not true. Or, at least, the suggestion that Trump is responsible for new, previously unannounced jobs is not true. The jobs are coming to the United States, but they are coming as part of a series of investments that were first announced in mid-October.

Sprint’s parent company, SoftBank, said in October that it would partner with a Saudi sovereign wealth fund to invest about $100 billion in the tech sector. On December 6, SoftBank CEO Masayoshi Son told Trump the company would use some of these funds to bring 50,000 jobs to the United States. Trump promptly announced as much on Twitter.


SoftBank confirmed to the tech news site Engadget that the 5,000 jobs Trump took credit for on Wednesday are “part of the 50,000 jobs that Masa previously announced.” The company added that the 50,000 jobs “will be a combination of newly created jobs and bringing some existing jobs back to the U.S.”

Yet, despite the fact that the 5,000 jobs Trump took credit for on Wednesday were already announced earlier this month and are part of a series of investments that were themselves announced in mid-October, numerous headlines presented Trump’s claim as fact.

In fairness, some of these outlets reported additional details about what actually happened in the body of their stories, although the many news consumers who only read these headlines would still be mislead. Some outlets also published far more informative headlines. Here, for example, is Bloomberg:

Sprint, it should be noted, helped Trump push a favorable line. “We are excited to work with President-Elect Trump and his Administration to do our part to drive economic growth and create jobs in the U.S.,” Sprint CEO Marcelo Claure said in a statement included in that release.

It’s also worth noting that Sprint has an incentive to help Trump use already-announced news to bolster his approval ratings. The company attempted a merger with its rival T-Mobile, but abandoned that effort in 2014 due to antitrust issues raised by the Federal Communications Commission.

After Trump takes power, however, Sprint could attempt to revive this effort under the new administration.

This week in the war on workers: What happens if Obama’s overtime expansion is reversed?

President Obama’s expansion of overtime pay goes into effect on December 1. But what happens if it gets rolled back in 2017? Here are some of the Department of Labor’s takeaways from a Congressional Budget Office report:

  1. CBO finds that reversing the rule would strip nearly 4 million workers of overtime protections. According to the report, there are nearly 4 million workers whose employers will be required to pay them overtime when they work more than 40 hours a week when the rule goes into effect.
  2. CBO finds that reversing the rule would reduce workers’ earnings while increasing the hours they work. The report finds that if the rule is reversed, the total annual earnings of all affected workers would decrease by more than $500 million in 2017. Further, these workers would earn less money while working more hours.
  3. At a time when income inequality is already of great concern, CBO finds that reversing the rule would primarily benefit people with high incomes. If the rule were reversed, affected workers, most of whom have moderate incomes, would experience a loss in earnings. These losses would be accompanied by an increase in firms’ profits, of which the vast majority (CBO estimates 85 percent) would accrue to people in the top income quintile.
  4. CBO finds that reversing the rule would not create or save jobs. The report finds no significant impact on the number of jobs in the economy.

Think It’s Tough for Labor Now? Just Wait Until Trump Takes Office in January

photo_321703[1]In 63 days, organized labor is going to find itself in a new political reality, which it seems totally unprepared for. Donald Trump will be president; the Republicans will control the House and Senate and one of Trump’s first tasks will be to nominate a new Supreme Court justice. Though Trump was tight-lipped about specific policy proposals, his campaign and the current constitution of the Republican party do not bode well for labor.

Trump’s actions will largely fall into one of four categories: judicial, legislative, executive and at the level of federal agencies. Each potential move will take various levels of cooperation from other branches of government and varying amounts of time to complete.

On Day 1 of his new administration, President Trump can simply rescind many of Barack Obama’s executive orders that benefited large groups of workers. Chief among these were EO 13673, which required prospective federal contractors to disclose violations of state and federal labor laws, and helped protect employees of contractors from wage theft and mandatory arbitration of a variety of employment claims. Similarly, EO 13494 made contractor expenses associated with union busting non-allowable, thereby helping to ensure that workers can exercise their labor rights.

At the agency level, Trump will have the opportunity to fill vacancies on the five-person National Labor Relations Board (NLRB), effectively turning what has been one of the most pro-worker boards in recent memory into one that is more concerned with employers’ interests. The NLRB is one of the more politicized federal agencies, and it is not uncommon for a new NLRB to overturn a previous board’s rulings. A conservative board would put into jeopardy recent gains, including the requirement of joint employers to bargain with workers, the rights of graduate students to form unions, the rights of adjuncts at religious colleges to form unions and the protections from class action waivers in employment arbitration agreements, which effectively block access to justice for too many.

Similarly, Trump can immediately dismiss the entire Federal Service Impasses Panel (FSIP) and appoint his own members. The FSIP is a little-known federal agency that functions like a mini-NLRB to resolve disputes between unionized federal employees and the government.

At the legislative level, various anti-worker bills sit ready for a GOP-led push. Perhaps chief among them is the National Right to Work Act, which would place every private sector employee (including airline and railway employees currently under the Railway Labor Act) under right-to-work. Right-to-work is the misleading law that prohibits unions from requiring that workers represented by the union pay their fair share. Such a bill was introduced last year by Sen. Rand Paul, and it had 29 co-sponsors, including Senate Majority Leader Mitch McConnell. Trump announced on the campaign trail that his “position on right-to-work is 100 percent,” so this will likely be an area where he has common cause with the GOP-controlled Congress.

At the judicial level, there is also a strong possibility that we will see a sequel to the Friedrichs case at the Supreme Court. Friedrichs was widely anticipated to bar fair share fees and place all public sector employees under right-to-work, but ended in a deadlock after Justice Antonin Scalia’s death. It is likely that any Supreme Court justice that Trump chooses will be as critical of fair share fees as Justices Samuel Alito and John Roberts, and would provide a critical fifth vote in changing long-standing precedent regarding the allowance of such fees. Groups like the National Right to Work Committee and Center for Individual Rights often have cases in the pipeline that could be pushed to the Supreme Court when the opportunity arises.

Similarly, at the judicial level, Trump will likely have his Department of Labor drop appeals to court decisions that enjoined or overturned pro-worker rules, such as the rule requiring union-busters to disclose when they are involved in an organizing campaign. Dropping the appeals would be an easy route to kill the rules, rather than going through a more time consuming rulemaking process to rescind them.

All indications are that labor has been caught unprepared for a President Trump and a GOP-controlled Congress and Supreme Court. With such broad control over every branch of government, Trump may be able to not only roll back many of Obama’s accomplishments, but also change the face of labor law for decades to come.
